Terms of Service for High Maintenance Tree Service

Effective Date: December 2025

These Terms of Service ("Terms") govern the service agreement between you, the Client, and High Maintenance Tree Service ("we," "us," or "our"), a family-owned and operated tree service company in Dunnellon, Florida. By accepting a service quote, scheduling work, or engaging with our services, you agree to be bound by these Terms.

1. Acceptance and Scope of Work
 

  • Quote Acceptance: A formal agreement is created when the Client accepts a written quote or estimate provided by High Maintenance Tree Service.

  • Scope Definition: The scope of work is strictly limited to the services explicitly described in the accepted quote. Any changes or additions must be agreed upon in writing and may result in a price adjustment.

  • ISA Standards: All trimming, pruning, and health work will be performed using industry best practices and standards set by our ISA-Certified Arborists.


2. Payment Terms
 

  • Deposits: We may require a non-refundable deposit to secure the scheduling of complex or high-value jobs. This deposit amount will be detailed in the service quote.

  • Final Payment: Final payment is due upon satisfactory completion of the contracted work. Payment must be rendered immediately following the crew's final cleanup inspection unless a prior written agreement for an alternate schedule has been made.

  • Late Fees: If payment is not received on the due date, we reserve the right to charge late fees or interest as permitted by Florida state law.


3. Client Responsibility and Site Preparation
 

  • Access: The Client must provide clear and unobstructed access to the work area on the scheduled date.

  • Marking Hazards: The Client is solely responsible for clearly marking all underground utilities, sprinkler lines, dog fences, septic systems, or other unseen hazards. High Maintenance Tree Service is not responsible for damage to unmarked or undisclosed property features.

  • Permits: The Client is responsible for securing any necessary permits (e.g., city permits for large removals, HOA approvals) prior to the start of the work.


4. Cancellation and Rescheduling
 

  • Client Cancellation: If the Client cancels or reschedules the job less than 48 hours before the scheduled service time, the deposit may be forfeited to cover lost scheduling time and mobilization costs, as described in our Refund Policy.

  • Company Cancellation/Delay: We reserve the right to cancel or reschedule work due to hazardous weather conditions (e.g., high winds, lightning), major equipment failure, or crew safety concerns. In such cases, the Client will be notified as soon as possible, and all deposits will be credited toward the rescheduled date.


5. Liability and Damage
 

  • Property Damage: We take every precaution to prevent property damage (e.g., using specialized low-impact equipment, protective matting). We are fully licensed and insured against accidental damage caused by our crew. Claims of property damage must be reported to the crew supervisor immediately, or within 24 hours of completion, to be considered valid.

  • Existing Conditions: We are not responsible for damage resulting from existing, non-visible conditions (e.g., rotten wood, structural weakness) that contribute to tree failure during the work process.


6. Tree Ownership
 

The Client warrants that all trees and shrubs addressed in the service quote are located on their property and that the Client is the legal owner or has the legal authority to contract for the requested services.

7. Governing Law

 

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.
